Responsibility of a carrier
Planning to order cargo transportation services? It is worth knowing the guarantees that you can make use of in the event your cargo is damaged or lost during carriage.
If your cargo is damaged or lost during transportation, you have the right to apply for compensation to the carrier of the cargo. The carrier of your cargo is responsible for losses resulting from improper transportation. Losses incurred due to inadequate packaging, incorrect shipping information or other matters not related to carriage do not fall within the responsibility of the carrier.
International agreements defining the responsibility of the carrier:
- Warsaw Convention (Air Waybill Insurance): The carrier’s liability in the case of carriage of goods by air is limited to USD 29 per gross kilogram of cargo.
- Convention on the Contract for the International Carriage of Goods by Road (CMR): The carrier’s liability in the case of carriage of goods by road is limited to USD 10 per gross kilogram of cargo.
- Hague-Visby Rules (Bill of Lading Insurance): The carrier’s liability in the case of carriage of goods by sea is limited to USD 2.4 per gross kilogram of cargo or USD 800 per shipping container.
To avoid possible losses, it is advisable to have your high-value cargoes insured against potential risks.
